In evaluating whether real property is subject to equitable distribution (sharing with your spouse) upon divorce, it is important to consider:
a) when property was acquired
b) was property lived in by both parties and for how long
c) who paid to acquire the property and did the other spouse contribute to it in any way
d) what was the intention of use of the property
e) was any portion of monies used to acquire the property a gift
Simply because a property was acquired before marriage or gifted, it may not automatically be exempt from equitable distribution.
